Plaintiff-Appellant Robert A. Neinast moves the Court for leave to file an Appellant Brief in excess of 30 pages and a Reply Brief in excess of 15 pages, but still within the type-volume limitations provided for in FRAP Rule 32(a)(7)(B).

LEGAL ARGUMENT

The Briefing Schedule of May 13, 2002, based on Plaintiff-Appellant being a pro se litigant, specifies a maximum of 30 pages for Plaintiff-Appellant's Brief and a maximum of 15 pages for the Reply Brief of Plaintiff-Appellant, but specifies type-volume limitations for Defendants-Appellees' Brief. Before receiving the Briefing Schedule, Plaintiff-Appellant had already relied upon the type-volume limitations section of the Federal Rules of Appellate Procedure Rule 32 while preparing his brief, had already written in excess of 30 pages, and will be severely handicapped if forced to restrict his arguments to a 30 page limit while Defendants-Appellees are allowed 14,000 words.

In addition, this case presents two matters of first impression in the Circuit: the right to receive speech at a designated public forum, and the right of personal appearance of an adult citizen who is not a government employee. A proper exposition of those matters requires that Plaintiff-Appellant not be artificially constrained when neither the Federal Rules of Appellate Procedure nor the Sixth Circuit Local Rules require it.

Both FRAP Rule 32 and the simple justice of applying the rules equally to both parties require that this motion be granted.
