This matter came before the court upon Plaintiff's Motion for the Court to Amend its December 9, 2009. On January 7, 2010, Defendant filed a Motion for Summary Judgment.

Upon consideration, this court hereby VACATES its Entry of December 9, 2009. It is hereby ORDERED:

[1] Plaintiff may file his Memorandum Contra to Defendant's Motion for Summary Judgment on or before January 22, 2010 and may file his Reply to Defendant's Response to Plaintiff's Motion for Summary Judgment on or before January 14, 2010.

[2] Defendant may file its Reply to Plaintiff's Memorandum Contra on or before seven [7] days from the filing of that Memorandum Contra.

This matter shall come on for a non-oral hearing on the parties' respective Motions for Summary Judgment on February 3, 2010.

This matter shall proceed accordingly.
