This matter came on for consideration of the court upon Plaintiff's Motion for an Order Regarding the Evidentiary Hearing. Defendant filed a Response.

Upon consideration, this matter will come on for an evidentiary hearing on March 8, 2011 at 9:00 a.m., the scope of which will be as directed by the November 30, 2010 Decision of the Fifth District Court of Appeals.

Since this matter is scheduled for a hearing and not a trial, Loc.R. 2.4 does not apply and no scheduling order will be issued by the court. If the parties wish to engage in discovery they may do so. Pursuant to the Fifth District's November 30, 2010 Decision, Defendant will have the burden of going forward and presenting evidence on the issues as set forth in the November 30, 2010 Decision.
