This matter came on for consideration of Plaintiff Robert A. Neinast's Motion for Leave to File an Amended Complaint. A copy of the proposed Amended Complaint was submitted with the Motion. Upon due consideration thereof, the court finds that leave should be given in the interest of justice.

It is therefore ordered that Plaintiff be granted leave to serve an amended complaint within 7 days after the date of this order. Defendant is required to move or plead to the amended complaint within 14 days after service thereof.
