ENTRY


This matter came before the court upon Defendant's Motion for Continuance of Evidentiary Hearing. Plaintiff filed a Response and a Motion to Convert Evidentiary Hearing to Non-Oral Hearing. Defendant filed a Memorandum Contra to Plaintiff's Motion to Convert.

In its Opinion and Judgment Entry filed on November 15, 2010, the Fifth District Court of Appeals held:

"We remand this case to the trial court to determine if in fact appellee can establish reasons for the footwear rule that applies specifically to Appellee."

Upon consideration and pursuant to the above remand of the Fifth District Court of Appeals, therefore, Defendant's Motion for Continuance is hereby GRANTED and Plaintiff's Motion to Convert is hereby DENIED. This matter shall come on for an evidentiary hearing before the court on February 16, 20100 at 3:00 p.m.1 

It is so ORDERED.
