NOTICE OF ADDITIONAL AUTHORITY


Plaintiff wishes to inform the court of an additional authority which has recently come to his attention (and which took six weeks to get from the office of the Mahoning County Clerk of Courts). That authority is Curran v. City of Youngstown, Case No. 186118 (Mahoning County Court of Common Pleas, Apr. 21, 1969). In that case, the court declared unconstitutional Youngstown’s ordinance prohibiting walking with bare feet in certain parts of their downtown. One of the reasons the ordinance was declared unconstitutional was that the state’s police power did not extend to such an ordinance (p. 4). A copy of that opinion is attached.
